Requesting a Directive

DIRECTIVE REQUESTS SHOULD BE SUBMITTED AT LEAST TWO WEEKS IN ADVANCE OF THE DATE IT IS NEEDED.
REQUESTS INVOLVING MULTIPLE MEMORIALS, METES/BOUNDS LEGAL DESCRIPTIONS OR IS COMPLEX WILL REQUIRE ADDITIONAL TIME FOR PROCESSING.

  • No fee to draft a Directive; there is a fee to record the Directive
  • Recording a Directive:  Fee for one certificate is $46 and $20 for each additional certificate
  • When mailing items to our office, please HIGHLIGHT “Examiner of Titles Office” and/or “ATTN: Tracy Ekberg” on the envelope

General requests

Correct Personal Name

Send written request via email to tracy.ekberg@anokacountymn.gov or letter that indicates the certificate of title number(s) affected; and

Mail a letter requesting the Directive that indicates the certificate of title number(s) affected; and

Mail a letter requesting the Directive that indicates the certificate of title number(s) affected; and

Mail a letter requesting the Directive that indicates the certificate of title number(s) affected; and

Describe exactly what memorial(s)/recital(s) need to be removed and include copies of document(s) that support your request, if necessary

Include an original, signed and notarized, Affidavit from the party whose name is incorrect, stating the document and document number where the name is incorrect and including a detailed explanation as to how/why the name is incorrect; and

Include an original, signed and notarized, Affidavit from the party explaining the correct marital status and stating the document and document number where the marital status is incorrect

Include an original, signed and notarized, Affidavit from an officer of the business stating what is incorrect explaining what document was incorrect (include specific document number of deed, mortgage, etc.) and how it was incorrectly spelled (must include a statement of the true and correct spelling of the name of the business); and

Indicate if:

  • you will be picking up, 
  • if we will be mailing (include mailing address or UPS/FedEx label), or
  • if we will be recording the Directive (include the recording fee with the request; make checks payable to “Anoka County”)

Include a copy of the party's Driver’s License (as proof of the correct spelling) and, if necessary, any documents regarding legal name changes (marriage certificate, divorce decree, court order, etc.)

Indicate if:

  • you will be picking up, 
  • if we will be mailing (include mailing address or UPS/FedEx label), or
  • if we will be recording the Directive (include the recording fee with the request; make checks payable to “Anoka County”)

Include a Certificate of No Record from the Secretary of State stating there is no business existing with the INCORRECT name as stated on the Certificate AND a document from the Secretary of State stating the CORRECT business name is a legitimate and existing company

The Examiner of Titles does not draft Directives to remove Financing Statements; they will drop after 5 years upon transfer of property, unless a Continuation of Statement is recorded – then the expiration is extended for an additional 5 years; if there is a bankruptcy, it will extend the expiration an additional 60 days past the 5 years

Removing recitals/memorials from a certificate of title

Your certificate of title may show liens or interests that are no longer valid.  To learn if those interests will be dropped by the registrar or will require an examiner's directive, please view this document (PDF).

Exchange Certificate

Registered owners (or agents of the registered owners) can request an Exchange Certificate from the Registrar of Titles for a fee of $40.  The Certificate of Title will be free from memorials of all interests which have terminated.  For additional information, please contact (763) 323-5400.
